Terms of Service

What you agree to when you use Accelimate AI, in plain terms.

These terms govern your use of Accelimate AI: this website, the Accelimate AI product you log in to, the websites and services it runs for you, and the Accelimate AI mobile app (together, the "Service"). By using the Service you agree to them. If you are agreeing on behalf of a business, you confirm you are authorized to bind it.

1. Accounts

Keep your sign-in details confidential. You are responsible for activity under your account and for the people you invite into it. Tell us promptly if you believe your account has been used without your permission.

You must be at least 18 years old and able to form a binding contract to use the Service.

2. What we provide

Accelimate AI runs your website, store, and back office: the site itself, forms, bookings, your customer records, messaging, and the AI that helps you build and run them. Some plans and add-ons also include services performed by people, such as review of your books by an accounting professional. What your plan includes is shown in your account and on the pricing page.

We aim to keep the Service available and correct, and we may change, improve, or discontinue features. If we make a material change that reduces core functionality during a paid term, we will tell you first.

3. Your website and what you publish

You are responsible for what your website says and sells, and for making sure it complies with the laws that apply to your business. We provide standard legal pages for your site as a starting point; it is your responsibility to make sure they fit how you actually operate.

4. Messages you send

When you use the Service to send email, text messages, or calls, you are the sender. You must have the consent the law requires before you contact someone, honor opt-outs, and follow the rules that apply, including CAN-SPAM and the Telephone Consumer Protection Act. We may pause sending that is harming deliverability for other customers or appears to break those rules.

5. AI in the Service

AI drafts and edits content, screens inbound messages, and, where you turn it on, answers your customers. AI can be wrong. Review what it produces before you publish or rely on it, and do not use it to give advice that requires a licensed professional. You are responsible for what is published or said on your behalf.

6. Acceptable use

Do not:

  • attempt to access another customer's data or another person's account;
  • probe, scan, or interfere with the security or integrity of the Service, or attempt to circumvent access controls or usage limits;
  • publish, sell, or send anything unlawful, infringing, deceptive, or malicious;
  • use the Service to send unsolicited bulk messages;
  • use the Service to build a competing product, or scrape it at scale.

7. Your content and your data

You keep ownership of your content, your website, and the information you put into the Service, including your customers' information. You grant us the rights we need to host, process, and display it in order to run the Service. We hold your customers' information on your instructions and do not use it for our own purposes.

We keep ownership of the Service itself and everything we built into it. Nothing here transfers our intellectual property to you.

8. Plans, fees and AI usage

Every plan starts with a 14-day free trial, and no card is required to start. If you do not subscribe by the end of the trial, your site stays up for a 7-day grace period and is then paused, not deleted.

Plans are billed month to month, in advance. You can cancel at any time; cancellation takes effect at the end of the period you have paid for. Refunds are handled as described in our trial, cancellation and refund policy. We may change prices, and we will tell you before a change applies to your next renewal. We may pause your site for non-payment after notice.

Each plan includes a monthly AI allowance. You can buy more; purchased AI tokens do not expire and are used after the month's included allowance. If you turn on overage in Billing, use beyond your allowance and purchased tokens is invoiced at the end of the month; if you leave it off, AI actions stop at the allowance.

If you bought access through an agency or reseller, your billing relationship is with them, and their terms govern payment.

9. Mobile app

We grant you a personal, non-transferable, revocable license to install and use the Accelimate AI mobile app on devices you control, for as long as your account is active. App store terms also apply to your download. Apple is not a party to these terms and has no obligation to provide support for the app.

10. Suspension and termination

You may cancel at any time. We may suspend or terminate access for breach of these terms, for non-payment, or where required by law. When a subscription ends your site is paused, not deleted, so you can come back; ask us to delete it and we will, as described in the Privacy Policy.

11. Disclaimers

Except as expressly stated, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the Service will not exceed the fees you paid for the Service in the twelve months before the event giving rise to the claim.

Nothing in these terms limits liability that cannot be limited by law.

13. Indemnity

You will defend and indemnify us against third-party claims arising from your unlawful use of the Service, your breach of these terms, what your website publishes or sells, or the messages you send through the Service.

14. Changes

We may update these terms. If a change is material we will give notice in the product or by email before it takes effect. Continuing to use the Service after that means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of laws rules. The state and federal courts serving York County, Pennsylvania have exclusive jurisdiction, and each party consents to venue there.
